General Terms and Conditions of Kaukasus-Reiseservice Ltd. as of 15.01.2017

1. Registration and confirmation
By registering you offer us the conclusion of a travel contract. The contract is binding with the confirmation in writing of the travel contract by our booking confirmation.

2. Payment
After receiving the booking confirmation a 20 % deposit of the total price is due at the date stipulated. The final payment will take place via bank transfer or cash at site prior to the start of the tour.

3. Services
The scope of services results from the description in the itinerary and from the specifications of our services as agreed in the booking confirmation. Subsidiary agreements that alter the contractual scope of travel will be binding only by our confirmation in writing.

4. Service- and price alterations
We reserve our rights to change services and prices due to changed circumstances. (for instance raise of transportation costs or strong exchange rate fluctuations). In case of an increase of the price of over 5% or in case of a significant change of the itinerary you can cancel your reservation and/or contract with no fees attached.

5. Withdrawal by the customer
You can withdraw from the travel contract at any time prior to departure by a written statement.
Relevant is the time of receipt of the cancellation.
Following fees of cancellation apply: up to 30 days before departure: 0% of the price, 29-15 days before departure: 50% of the price, 14-7 days before departure: 60% of the price, 6-2 days before departure: 80% of the price. 1 day before departure or a no-show: 100% of the price.
It is possible to have your reservation replaced by someone else however fees for cancellation and changes of the reservation can be up to EUR 100 per passenger depending on the airline and conditions.
It is strongly recommended to take out travel cancellation insurance.

6. Cancellation by the tour operator
A. Upon failure to achieve the minimum number of participants as stated in the travelogue the tour may be canceled up to 14 days prior to departure. Paid prices will be fully refunded.
On request the price can be recalculated based on the lower number of participants. It is also possible to have the tour re-booked to another date.
B. We reserve our right to deny customers in participating the tour if we think that their and other’s safety is not guaranteed due to lack of fitness, sure-footedness or any other circumstances that might endanger the tour.
Participants who behave disrespectfully, aggressively or in any other such way that might hinder the continuation of the tour may be excluded after a warning without the possibility to claim back any payments or parts of it.

7. Cancellation of the contract due to exceptional circumstances
If the trip is hindered, endangered or impaired due to unforeseen exceptional circumstances both sides can withdraw from the contract. Any additional costs for the return shall be split equally by both parties.

8. Liability
You undertake the journey at your own risk and are responsible for your physical integrity.
The tour organizer is responsible for a conscientious travel preparation and for ensuring a proper organization and implementation of the agreed services, for a careful selection and monitoring of the tour guide on site and for the correct execution of the itinerary.
The tour organizer assumes no liability for disturbances by third-party services (for example airlines) or changes in the tour plan due to weather conditions and force majeure. The contractual liability for damages other than personal injury is limited to three times the travel price if the damage of the traveler was caused neither intentionally nor by gross negligence.

9. Verification
If the tour service is not provided as stated in the contract the traveler may apply for a restitution. Complaints must be reported in writing immediately to the tour organizer. Claims by the traveler are possible but must be made in writing within 4 weeks after return.

10. Equipment
Equipment provided by the tour organizer such as saddles, tents, sleeping bags, fishing equipment etc. are to be handled carefully. In case of deliberate damage the participant has to bear the costs for repairs or replacement

11. Passport-, visa- and health regulations
The traveler is responsible for compliance with these regulations. Please check with your Department for Foreign Affairs for the latest updates concerning traveling to Georgia. Travelers from most countries don’t need a visa to travel to Georgia if the duration of stay does not exceed 364 days. If needed we can assist you in completing the visa formalities.
However, the application for the visa can only be done by the participant.

13. Intellectual Property
All ideas and conceptual approaches are the property of Kaukasus-Reiseservice Ltd. and may not be used or distributed to third parties without consent. Contravention will be object of legal action.

14. Severability clause
The ineffectiveness of specific parts of the travel contract does not invalidate the entire travel contract.

15. The European Commission provides a platform for online dispute resolutions (OS). You can find the platform under http://ec.europa.eu/consumers/odr/

16. Place of jurisdiction
Place of jurisdiction is the address of the tour operator
